Terms of Service

These Terms of Service ("Terms") are an agreement between you and AgenticIndex ("AgenticIndex", "we", "us") about your use of getagenticindex.com and our paid services. By using the Site or buying a service, you agree to these Terms. If you buy for a company, you confirm that you have authority to bind it.

1. The directory

AgenticIndex is a directory of B2B AI agencies and implementation partners. Scores and rankings are our editorial opinions. They may be preliminary and are provided "as is". A listing does not mean we endorse an agency, and we are not a party to any agreement between buyers and agencies. Do your own due diligence before you hire anyone.

2. Paid services

Prices are in US dollars and do not include taxes unless stated. Payments are processed by Stripe under Stripe's terms.

30-Day Visibility Guarantee. If, during the first 30 days of a new paid plan, your listing receives neither a qualified buyer RFP match nor 50 or more profile views (views of your agency profile page, as counted by our first-party analytics), we will include a Featured Spotlight for your agency in the AgenticIndex Briefing newsletter at no additional cost. This is the sole remedy under the guarantee; it is not a refund and does not change the Refund Policy.

3. Subscriptions, renewal and cancellation

Subscriptions renew automatically at the end of each monthly or annual period, and we charge the payment method on file, until you cancel. You can cancel at any time through the Manage subscription page (Stripe customer portal) or by emailing support@getagenticindex.com. Cancellation takes effect at the end of the current billing period, and you keep access until then. We may change prices with at least 30 days' notice. A new price applies starting with your next renewal. Refunds are covered by our Refund Policy.

4. Listings and content you provide

You confirm that the information you submit is accurate and that you have the right to submit it, including logos and trademarks. You give us a non-exclusive, worldwide, royalty-free license to display, format and distribute that content on the Site and in related materials such as llms.txt, newsletters and badges. We may edit, decline or remove any listing or sponsorship at our discretion, for example for inaccuracy, misconduct or a breach of these Terms. If we remove paid placement for reasons other than your breach, we will refund the unused part of your prepaid fee.

5. Buyer requests

If you submit an RFP, you allow us to share it with agencies we think may be a good fit. We do not guarantee any responses, introductions or outcomes.

6. Acceptable use

Do not scrape the Site in a way that harms its operation, post false or misleading information, interfere with security, or use the Site for any unlawful purpose.

7. Affiliate links

Some outbound links are affiliate links, and we may earn a commission from them. Third-party sites and tools are governed by their own terms.

8. Disclaimers and limitation of liability

THE SITE AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS. OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

9. Indemnity

You will defend and indemnify us against claims that arise from content you submit or from your breach of these Terms.

10. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. The state and federal courts located in Massachusetts have exclusive jurisdiction.

11. Changes

We may update these Terms. If you keep using the Site after we post changes, you accept the updated Terms.
